Purchasing or Selling a Farm?

Perhaps you are planning a tree change, expanding your agricultural operations, or selling a long-held family property. Rural and farming transactions involve far more than simply transferring the land.


When buying or selling a farm, there are many additional matters to consider.


In many cases, the sale may include plant and equipment such as tractors, machinery, cattle yards or irrigation infrastructure. It is important that these items are clearly identified in the Contract to avoid uncertainty or dispute.

Rural properties may also involve:

  • Water entitlements and water shares
  • Irrigation licences
  • Government licences, permits and land use approvals
  • Stock and inventory (if applicable)
  • GST considerations, including “going concern” provisions
  • Fencing and boundary issues
  • Access arrangements and easements

Water rights and licences, in particular, can be complex and may require separate documentation and authority approvals to ensure they are properly transferred.


A thorough review of the Contract and associated documentation is essential to ensure all assets are correctly recorded and transferred, and that you understand your obligations and entitlements.
